Terms of Service

This document contains the general terms of service of Hobbly Technologies Oy, which apply to the Service described below.
1. General
1.1. Service Provider and Application Name
The Hobbly mobile application ("Service") is a digital mobile application provided by Hobbly Technologies Oy (Business ID: 3503150-1), designed to enable Users to discover hobbies, participate in them, join communities, and provide various content, benefits, and functionalities as part of the Hobbly concept.
1.2. Acceptance, Applicability, and Entry into Force of the Terms of Use
These terms of use ("Terms") govern the User's access to the Service and the conditions, rules, and restrictions related to its use. By registering for the Service, using it, or participating in any activity/functions offered through the Service, the User agrees to comply with these Terms and other supporting materials (privacy policy), which together constitute these Terms. (see section 12.1. on amendments to the Terms) If the User does not accept these Terms, they may not use the Service
1.3. Service Description and Purpose
The primary purpose of the Service is to provide Users with the opportunity to discover and explore various hobbies, join related communities, participate in events, and utilize gamified features offered by Hobbly. Through the Service, Users can also receive current information about Hobbly's development, new features, and other topical matters related to the Service. The Service Provider reserves the right to modify, expand, or restrict the Service's content and offerings without separate notice.
2. User Rights and User Terms
2.1. Registration Eligibility
Registering for the Service and creating a user account requires that the User meets the following requirements:
- The User must be at least 13 years old. However, in some countries, local legislation may set a higher age limit (e.g., 16 years), in which case that limit shall be observed
- The User must provide correct, accurate, and up-to-date information during registration. The User warrants that the information provided to the Service Provider is truthful, accurate, and complete, and commits to keeping it as such at all times.
- The User must reside in a country where the Service is available. The Service Provider may separately restrict the use of the Service in countries where providing the Service is not possible due to legislative or other reasons.
- The User must not have had a previous account in the Service that has been closed by the Service Provider due to a breach of these Terms or other comparable reason.
If the User does not meet the above requirements, they are not eligible for registration and may not register for the Service (see 2.2. on user account creation). If the User is a minor in their home country, their guardian or other parental responsibility holder must accept these Terms on their behalf.
2.2. User Account Creation, Management, and Closure
A User can create a user account in the Service only if they meet the registration eligibility requirements (see 2.1. on registration eligibility). Creating and using a user account requires that the User accepts these Terms and commits to complying with them. Using the Service is only possible by registering and creating a user account. The User is responsible for maintaining their account and related information up to date. The User must ensure that the information they provide remains accurate and current throughout the account's validity period. If the User notices incorrect or outdated information, they must update it without delay. The User may close their user account either on their own initiative from the Service settings or by requesting deletion from the Service Provider. The User understands that closing the user account is a permanent and irreversible action, and the closed user account or associated data cannot be recovered. Additionally, all possible Service-related benefits, achievements, or other rights that have accrued to the User will be lost upon account closure. The Service Provider has the right to close a user account unilaterally for the reasons described in these Terms (see 5.2. on consequences of violations)
2.3. User's Responsibility for Account Security
The User is solely responsible for the security of their user account, including the confidential and appropriate storage of account credentials such as username and password. The User must ensure that their account information does not fall into the hands of third parties and must take appropriate and reasonable measures to prevent unauthorized use, such as using a strong password and avoiding sharing account information with others. The User agrees to promptly notify the Service Provider of any suspicions related to unauthorized use of their account, security breaches, or other similar situations. Delays or failures in notification may lead to account misuse and possible damages. The Service Provider is not responsible for any damage or loss resulting from the User's negligence or omission regarding their account security (see 6.2. on liability limitations)
3. User Responsibility
The User commits to using the Service in accordance with these Terms, applicable legislation, and good practice. Prohibited actions include (but are not limited to):
- Using the Service for illegal or unauthorized activities;
- Attempting to disrupt, damage, or otherwise harm the Service's operation or other Users' experience;
- Using automated systems, bots, or other similar technical means to manipulate the Service;
- Creating multiple user accounts without the Service Provider's explicit consent;
- Engaging in harassment, hate speech, discrimination, or other offensive behavior in the Service
- Acting in a manner that violates another (third party) service's terms of use at our Service's expense
- Using the Service in a manner that could damage the Service Provider's reputation, business, or other users.
4. Content Publishing and Usage Rights
4.1. Content Usage Rights
Users may publish content in the Service, such as comments, images, videos, or other material (hereinafter "Content"). By publishing Content in the Service, the User grants the Service Provider a non-exclusive, transferable, sublicensable, royalty-free, and worldwide license to use, store, modify, display, share, publicly transmit, and otherwise utilize the Content only in connection with providing, maintaining, developing, and marketing the Service. This license remains in effect even after the User's account closure or Content removal, to the extent necessary for the Service's functionality or fulfilling statutory obligations.
4.2. User's Responsibility for Content
The User is responsible for all Content they upload or publish in the Service, including its usage rights and legality. By publishing Content, the User warrants and guarantees that:
- they have all necessary rights to publish the Content and grant it to the Service Provider under the conditions described above;
- the Content does not violate applicable legislation, these Terms, or third parties' intellectual property rights, privacy protection, or other rights;
- the Content is not offensive, misleading, hostile, illegal, or otherwise inappropriate
The Service Provider has the right, at its own discretion, to remove, restrict, or modify Content published by Users if it violates these Terms, is unlawful, or causes harm to Service Users or the Service Provider's operations.
The Service Provider is not responsible for Content published by Users or its possible consequences. The User understands that:
- Content uploaded to the Service may be visible to other Users;
- Content published in the Service is not pre-filtered/monitored;
- they publish Content at their own responsibility.
5. Service Monitoring, Moderation, and Sanctions
5.1. Service Provider's Monitoring of the Service
The Service Provider has the explicit right, but not obligation, to monitor Content published in the Service and Users' activities to ensure they comply with these Terms, applicable legislation, and good practice. The Service Provider may, at its own discretion, remove, hide, restrict, or modify content if it violates these Terms, infringes third parties' rights, is unlawful, or is otherwise harmful to the Service's operation and other Users.
5.2. Service Provider's Actions
If a User violates these Terms, the Service Provider has the right to take appropriate and reasonable measures based on the severity and recurrence of violations. The Service Provider may, among other things:
- Give a warning to the User and instruct them to correct their behavior;
- Remove or restrict Content published by the User either temporarily or permanently;
- Block or restrict the User's access to the Service either partially or completely
- Suspend or remove the user account if violations are serious and/or repeated
- Take other necessary measures, such as notifying authorities, if the User's actions violate the law or are otherwise required.
The User understands that the Service Provider is not obligated to notify in advance about monitoring measures and/or consequences of violations. The User also understands that the Service Provider always makes decisions based on its own discretion and has full right and authority to do so as the Service administrator. If a User's account is removed as a consequence of violating these Terms, the User has no right to account restoration nor compensation for lost benefits or Content. The Service Provider reserves the right to make changes to monitoring and sanction practices as necessary to ensure the Service's security, continuity, and quality.
6. Liability Limitation
6.1. Service Availability and Functionality
The Service is provided "as is" without any warranty of uninterrupted operation, completeness, or error-free performance. The Service Provider does not guarantee continuous or uninterrupted Service operation and is not responsible for possible outages or data loss.
6.2. Liability Limitations
The Service Provider is not responsible for:
- Users' actions or omissions in the Service;
- Possible direct or indirect damages resulting from using the Service;
- Third parties' actions or errors in services they provide
- Force Majeure situations, such as natural disasters, legislative changes, network problems, or other similar situations beyond the Service Provider's control
The User understands and accepts that they use the Service at their own risk.
7. Intellectual Property Rights
7.1. Service Content and Rights
All Content appearing in the Service, including but not limited to software, source code, databases, website structure and user interface, texts, images, graphics, logos, sounds, animations, and other materials, are the property of the Service Provider or its partners and are protected by copyright, trademark, patent, and other intellectual property rights. The Service Provider grants Users a limited, non-exclusive, and revocable right to use the Service in accordance with these Terms. This usage right does not include any transfer of ownership rights or the right to use the Service's content for purposes other than its original, Service-provided purpose.
7.2. User Restrictions
Without the Service Provider's explicit written permission, the User may not (but is not limited to):
- Copy, reproduce, modify, distribute, sell, rent, sublicense, or exploit the Service's content for commercial or other large-scale purposes;
- Disassemble, reverse engineer, modify, or attempt to determine the Service software's source code in whole or in part;
- Use the Service's content in a manner that may damage, weaken, or endanger the Service Provider's rights and reputation.
The Service Provider reserves the right to take necessary legal measures if the User violates these Terms or infringes the Service Provider's intellectual property rights.
8. Data Protection and Personal Data Processing
8.1. Personal Data Processing and Terms Formation
The Service Provider commits to protecting the User's personal data and processes it in accordance with applicable data protection legislation, the European Union General Data Protection Regulation (GDPR), and other applicable legislation. Using the Service requires processing personal data as described in the Service Provider's privacy policy, and the User accepts this by using the Service. 8.2. Data Security and Personal Data Storage
The Service Provider implements appropriate technical and organizational measures to protect personal data from unauthorized access, loss, misuse, and other possible risks. Personal data is retained only as long as necessary to fulfill their purposes and in accordance with legal retention obligations.
9. Applicable Law and Dispute Resolution
9.1. Applicable Law
These Terms are governed by Finnish law, excluding conflict of law provisions that could lead to the application of another country's law.
9.2. Disagreements and Dispute Resolution
The Service Provider and User primarily seek to resolve all Service-related disagreements in good faith through negotiation. The User should primarily contact the Service Provider's customer service (see 11. Service Provider contact information) and seek to find a solution without legal measures. If an agreement cannot be reached through negotiation, disputes will be resolved as indicated below in these Terms.
9.3. Dispute Resolution in Finland
Unless mandatory legislation provides otherwise, all Service-related disagreements shall be handled in the Helsinki District Court as the first instance.
9.4. EU and EEA Consumer Users
If the user resides in another EU or EEA country, they have the right to file a complaint through the EU Commission's online dispute resolution service. NOTE as of July 20, 2025! The European online dispute resolution platform (ODR) has been discontinued as of July 20, 2025, following the entry into force of Regulation EU 2024/3228 (EUR-Lex).
9.5. Data Protection Related Disputes
If the dispute concerns the processing of personal data, the User can file a complaint with the data protection authority.

9.6. Arbitration as an Alternative Solution
If the User and Service Provider cannot reach a solution through negotiation, the parties may agree to resolve the dispute through arbitration in accordance with the rules of the Central Chamber of Commerce Arbitration Board

11. Information About These Terms
11.1. Changes to Terms and Notification Thereof
The Service Provider reserves the right to change, update, or supplement these Terms at any time if necessary, for example, due to legislative changes, Service development, or implementation of new features. Users will be notified of changes through the Service or other appropriate means, such as email or a notice published on the Service's website. The User is deemed to have accepted the changes by continuing to use the Service after the changes take effect. If the User does not accept the updated Terms, they must stop using the Service.
11.2. Invalidity or Unenforceability of Terms
If any individual term of these Terms is deemed invalid, illegal, or unenforceable, it does not affect the validity of the other Terms. In such a case, the term deemed invalid shall be replaced with a similar and legal term that corresponds as closely as possible to the purpose and effects of the original term.
11.3. Transfer of Rights and Obligations
The Service Provider has the right to transfer its rights and obligations under these Terms in whole or in part to a third party without the User's consent if the transfer relates to business reorganization, merger, acquisition, or other similar business event. The Service Provider commits to notifying the User of such transfers in an appropriate manner if reasonably possible considering the circumstances. The User may not transfer rights or obligations based on these Terms to a third party without the Service Provider's prior written permission.
